OnlyFans Agency Contract: Clauses to Check Before You Sign

An agency contract decides who ends up owning your account, your money and your photos. We go through the most important clauses one by one, with the question to ask, the red flag and what a fair version looks like.

Note: This guide explains in general terms what to look out for. It is not a substitute for legal advice. Have your specific contract reviewed by a lawyer before you sign, ideally one with experience in contract or media law. The rules that apply depend on your state or country and on the law named in the contract.

Many problems with OnlyFans agencies don't start with a dispute, but with a signature. A contract signed in the first rush of excitement can tie you down for months or years, decides who may use your photos and determines whether you can leave at any time.

Let's go through the clauses one by one. For each one you get the question you should ask, a red flag and an assessment of what a fair arrangement looks like.

Before you read: four ground rules

  1. In writing or not at all. Verbal promises on the phone barely help you in a dispute. Whatever matters belongs in the contract.
  2. Get the contract as a file in advance. Don't sign anything you've only seen briefly on a screen.
  3. Check who you're contracting with. The company in the contract must be the same as the one named on the agency's website. How to check that is in our guide OnlyFans agency scams: warning signs to check first.
  4. Take your time. "Today only" isn't an argument, it's a pressure tactic.

1. Term

The question: How long am I tied in, and does the contract renew automatically?

Red flag: Fixed terms of a year or more, combined with automatic renewal and a long notice period. Then you're stuck, even if the work isn't good.

Fair: A short term or monthly cancellation. A good agency keeps you with results, not with clauses.

2. Cancellation

The question: How, with what notice and for what reasons can I cancel?

Red flag: Cancellation only "for cause", long notice periods, cancellation only by registered mail to an address abroad.

Fair: Short notice, cancellation in writing (for example by email), no reason required.

3. Contract penalties and exit fees

The question: Do I have to pay if I cancel, switch or break a clause? How much?

Red flag: Flat penalties for cancelling, "buyout sums" for switching to another agency, or penalties based on the revenue of the coming months. That turns a cancellable contract into one you practically can't leave.

Practical tip: Never pay a contract penalty hastily just because it's demanded. Get legal advice first.

Fair: No penalty for an ordinary cancellation. If anything, a clearly limited arrangement for genuine breaches.

4. Rights to your content

The question: What rights does the agency get to my photos and videos, for how long, and what happens after the contract ends?

Red flag: "The agency receives the exclusive right to all content, unlimited in time and territory." Or: content may still be used for advertising after the contract ends.

Fair: The rights stay with you. The agency may only use content for your account and your reach, and only during the collaboration. After the end, copies are deleted.

5. Logins and account

The question: Whose name is the account in, and who controls the email, password and two-factor login?

The OnlyFans Terms of Service are clear here: if someone helps you run your creator account, that doesn't change your legal responsibility. The platform's relationship is with you, not with third parties. So you're liable for everything that happens on your account. Then you should also control it.

Red flag: The agency creates the account itself, puts in its own email address or phone for two-factor login, or the contract declares the account or the fan list the agency's property.

Fair: Account, email, password, two-factor protection and payout details stay with you. The team works with the access you grant and can revoke at any time.

6. Payout route and billing

The question: Which account does OnlyFans pay out to, and how does the agency bill its share?

Red flag: OnlyFans pays out to an account of the agency, and you get "your part". Then you can no longer check what was really earned.

Fair: OnlyFans pays directly to you. The agency invoices you for its share, traceable from your own statements. The contract says whether the share is calculated before or after the OnlyFans fee of 20%. What that means in dollars is shown in our worked example under OnlyFans agency cost.

7. Exclusivity

The question: Can I work with others at the same time, use other platforms or run my own projects?

It's understandable that an agency wants exclusivity for managing your OnlyFans account, because two teams on one account lead to chaos. It becomes a problem when the exclusivity goes far beyond that.

Red flag: Exclusivity for all platforms and social media channels, non-compete clauses after the contract ends or an obligation to run all future collaborations through the agency.

Fair: Exclusivity only for what the agency actually manages, and only for the duration of the contract.

8. Boundaries and content

The question: Does the contract say what I show and what I don't, and who writes to my fans?

Red flag: Mandatory content quotas with penalties for falling short, or clauses that let the agency decide on the kind of content you make.

Fair: Your boundaries are set down in writing and are binding for the whole team.

9. Jurisdiction and governing law

The question: Where would I have to sue or defend myself in a dispute, and which law applies?

Red flag: A court in a distant country, combined with a foreign law you don't know. That makes enforcing your rights expensive.

Fair: A clear, openly explained arrangement. Ask if you don't understand it, and have a lawyer explain the consequences.

10. What happens after the contract ends

The question: What happens to access, content, data and the agency's share the day after cancellation?

Red flag: The agency's share keeps running for months, or the agency keeps access until a "handover" has been paid.

Fair: Access is revoked immediately, copies of your content are deleted, the agency's share ends with the contract.

FAQ

Can I get out of an OnlyFans agency contract early?

That depends on the contract and on the law that applies to it. Look for the term, the notice period and whether there are fees or penalties for leaving. If the contract makes leaving expensive or vague, have a lawyer review it before you sign or act.

Is an exit fee in an agency contract normal?

A fair contract has no penalty for an ordinary cancellation. Flat fees for leaving, buyout sums for switching agencies or penalties based on future revenue turn a cancellable contract into one you practically can't leave.

Can the agency keep using my photos after the contract ends?

That depends on which usage rights you granted. Make sure any rights are limited to your account and your reach, and only for the duration of the collaboration, and that copies are deleted afterwards.

Do I have to give an agency my password?

A team needs access for chatting, but your password, email address, two-factor protection and payout details should stay under your control. According to OnlyFans, you remain responsible for the account even when someone helps you.

Do I need a lawyer for an agency contract?

It's recommended, especially with a long term, contract penalties or a transfer of rights. This page is not legal advice.
